A growing and entrepreneurial law firm is seeking an experienced Litigation Attorney to join its expanding Trusts & Estates Litigation Practice in New York. This is an excellent opportunity for an attorney who enjoys handling sophisticated, high-stakes disputes while working closely with clients through complex and often sensitive personal and family matters.
The ideal candidate will have a minimum of five years of litigation experience and a strong foundation in one or more of the following areas: trusts and estates, fiduciary litigation, guardianship proceedings, Surrogate's Court practice, elder law, or matters involving issues of capacity and undue influence.
This position offers substantial client contact, meaningful courtroom experience, and the opportunity to work on challenging matters alongside experienced practitioners in a collaborative and supportive environment.
Position Overview
The attorney will manage a diverse caseload involving contested estate and trust matters, fiduciary disputes, guardianship proceedings, and related litigation in New York Surrogate's Court, Supreme Court, and federal courts. The successful candidate will be comfortable taking ownership of matters, developing litigation strategy, and guiding clients through emotionally charged and financially significant disputes.
Key Responsibilities
Handle all phases of trusts and estates litigation matters from inception through resolution
Represent clients in Surrogate's Court, Supreme Court, and federal court proceedings
Draft and argue motions, pleadings, discovery requests, and other litigation-related documents
Conduct depositions, witness examinations, and fact investigations
Appear at court conferences, hearings, mediations, and trials
Advise fiduciaries, beneficiaries, executors, trustees, and family members regarding contested estate and trust matters
Handle disputes involving:
Will contests
Trust contests
Fiduciary misconduct claims
Accounting proceedings
Guardianship matters
Capacity and undue influence claims
Estate administration disputes
Collaborate with attorneys across practice groups to develop effective client solutions
Maintain strong client relationships through clear communication and strategic counsel
Qualifications
Juris Doctor (J.D.) from an accredited law school
Admission to the New York Bar required
Minimum of five years of litigation experience
Experience in one or more of the following:
Trusts and estates litigation
Fiduciary litigation
Surrogate's Court practice
Guardianship proceedings
Elder law matters
Capacity and undue influence disputes
Strong legal research, writing, and analytical skills
Experience drafting substantive motions and litigation documents
Deposition and courtroom experience preferred
Ability to manage multiple matters independently while maintaining exceptional attention to detail
Strong interpersonal skills and the ability to counsel clients through sensitive and emotionally complex situations

Work Arrangement
This position will begin as a fully in-office role to facilitate integration, training, and collaboration. Following a successful onboarding period, attorneys may have the opportunity to transition to a hybrid schedule consisting of four days in the office and one remote workday per week.
